General terms and conditions of sale

Article 1: Application of the General Terms and Conditions of Sale

The present conditions are applied to the sale of all products by the Domain Pierre Richard on our website store on internet (www.domainepierrerichard.com). When passing an order on our website, this implies total accession to the General Terms and Conditions, and excludes any reference to all other documents such as flyers or catalogues which the seller can also produce and which have only an information aspect.

The fact that the seller does not make reference to these general conditions must not be interpreted as a renunciation for a future use of these general conditions. Unless stated otherwise by a written document between the parties, all on-line orders are therefore subject to the given General Terms and conditions of Sale, no matter all other clauses which the seller could insert in other documents. Our offers are exclusively reserved to our private clients, and do not include professional dealers.

Therefore, the final validation of the on-line order is a total acceptance of these General Terms and Conditions. Subject to modifications, the conditions applied here are the General Terms and Conditions on our website at the date of the order.

Article 2: Terms of order and payment

Orders are definitive only after confirmation of payment by the buyer. Payments are possible by cheque, bank transfer or credit card. At the request of the client, an invoice can be sent by mail or directly to his address. Payments by credit cards are secured by a protected system of payment (SSL norms). Furthermore any bank information given to us during your online purchases are not kept and are not visible on internet. The Domain Pierre Richard guarantees confidentiality of all your private data.

The wines ordered remains the property of the Domain Pierre Richard until final and full payment of the invoice, in accordance with law n° 80 336 dated may 1st, 1980. However, the buyer becomes immediately responsible of the articles on delivery. The transfer of ownership is equivalent to a transfer of risks. All our offers are valid within the limit of available product stock, without engagement and unless other sales occurring in between. In case of a rupture on a product already purchased and where it was stipulated “in stock” on the website, the Domain Pierre Richard will contact you within 48 hours to propose a change of product or partial or total refund of your order at your convenience.

Article 3: Prices

Prices are in Euros with VAT included (French VAT or other taxes applicable). The prices indicated do not include the transport fees. The total amount due, indicated in the confirmation of your order by the Domain Pierre Richard is the definite price to pay, and this includes the taxes. The final price comprises the price of the product, the handling, packing and conservation fees, administrative and transport fees. The Domain Pierre Richard may modify their price lists at any moment. All promotional offers (reduction vouchers, partnership reductions) are limited to one person per household and per operation. Article 4: Delivery and reception

At the reception of the order on the website of the Domain Pierre Richard and after payment and acceptance of our verification department, the delivery process can start. Delivery of the articles ordered is done at the household of the buyer or at any address indicated on the order form. In case of an error or incomplete information given by the buyer, the seller will not be responsible in case of an impossibility to deliver the product.

In case of non delivery and return of the product, the buyer will be proposed two alternatives:

-          redelivery after payment of a small participation of delivery fees,

-          refunding of the order after deduction of the delivery fees.

All orders are delivered once and at one point of delivery.

Article 5: Control

In the case of a rejection of your order by our Control department, the Domain Pierre Richard is entitled to demand a proof of identification and address (and a KBIS extract for a company). In case of a refusal by the buyer or non compliance of the documents requested, the Domain Pierre Richard may require a payment by bank transfer and cancel the credit card operation or destroy the cheque sent by the buyer.

Article 6: Delivery period

The Domain Pierre Richard commits to put all efforts for a good delivery in the best possible time. The delays vary according to the availability of the product, the type of transport and the country of destination. If the buyer orders different products with different delivery delays, it is the longest delay which will be applied for the whole order. Delivery is completed when the product is delivered to the final recipient or if absent, he is informed by a notice of availability. The eventual delays in delivery does not give the right to the buyer to cancel his order, to refuse the products or to claim damages. The delivery period starts after reception of payment or bank authorization in case of credit card transactions, and after agreement of our control department. In case of major events such as a war, strikes, fire, accidents, … the seller is discharged of his obligation of delivery.

Also, the buyer on reception of his order becomes responsible of it and must check that it is correct and if not, must note his comments on the delivery notice given to him by the carrier or can immediately call the client service of the transport company, in the presence of the chauffeur. He must also address a letter to the Domain Pierre Richard in the delay of 48 hours after delivery AND also he must address an email for our information at our email address: domainepierrerichard@wanadoo.fr.

Article 7: Stock shortage

In case of a definite stock shortage on a product ordered, the Domain Pierre Richard will keep you informed in the best possible delay, and will propose different solutions:

-          replacement by the following vintage or by an equivalent product or one of a superior quality but with the same price conditions,

-          reimbursement of the products which are out of stock or of the complete order itself according to the client’s choice.

In the case of a partial shortage of stock, we may propose to the buyer to wait until the next resupply, date to be specified to him.

Article 8: Possibility of retraction

In application of the Article L121-16 of the French Consumer code, the buyer has a right to a delay of 14 days as from the delivery of his order, to send this order back to the seller, to exchange or to be reimbursed, in a good state and in the original package with the orginal invoice. In case certain products have been consumed these will be deducted from the sum of reimbursement.

The return fees will be at the charge of the buyer.

The client must inform his decision to the Domain Pierre Richard before returning the products, by a carrier chosen by the client.

In case the client notices an abnormality with his order for example a product not corresponding to his order, the Domain Pierre Richard will automatically reimburse the total fees (price of the product + the return fees if the products are sent back in a good condition).

Article 9: Litigation

The present General Terms and Conditions of Sale are under the application of the French Law. In case of a litigation, the client must first propose an amicable solution to the seller. In default, all resulting conflicts on the execution of the order, or a bad interpretation of the General Terms and Conditions of Sale, any conflict of all nature will be submitted to the Commercial Court of Lons-le-Saunier (Jura).

In the case of non payment, a compensation of 10% of the total invoice (with a minimum of 45 Euros) will be demanded, all without prejudice to damages and interests for malicious prosecution.

Article 10: Legal information

According to Law n° 2009-879 dated July 21st, 2009, “Loi Bachelot” which stipulates a prohibition of sale of alcohol to minors (less than 18 years old), the buyer specifies when completing the order form, to be 18 years old at the date of the order.

Alcohol abuse is dangerous for your health. Please consume and appreciate moderately.

According to the law on Data protection, Article 27 of Law n° 78-17 dated January 6th, 1978, all personal data given by the client to the Domain Pierre Richard may give the client a right of access and rectification. The present website has been declared at the CNIL.

In order to meet the needs of the client and to ensure a good service for deliveries, we may record some personal data (name and surname, address, telephone). The personal data are to be used exclusively by the Domain Pierre Richard.

Payments by credit card are secured by a protected payment website system (SSL norms). Furthermore all bank information communicated to us during your shopping online are not stocked or visible on internet. The Domain Pierre Richard guarantees confidentiality of all your data.
